Terms of service and messaging terms

These terms cover use of the Thermofi service and, in the second half, the alert messages we send. By using the service or by being designated as an on-call contact for a building, you agree to them.
The service
Thermofi monitors and controls heating and cooling in buildings a customer asks us to manage. We aim to keep the service running continuously, but it depends on the customer's network, power and HVAC equipment, and on third-party carriers and cloud providers. Thermofi is not a life-safety system. Do not rely on it as the only protection against freezing, flooding, fire, or any condition that could cause injury or property damage.
The customer is responsible for keeping designated contacts accurate, for the physical security of installed equipment, and for the accuracy of the building configuration they give us. We may suspend the service for non-payment or for use that endangers the platform or other customers.
Alerts and messaging
This section is the messaging program disclosure. It applies to the SMS alerts we send to on-call contacts.
- What the program sends. Operational alerts about the buildings you are on call for: a zone that is too cold or too warm, humidity high enough to risk condensation, heating or cooling equipment that is running without effect, and devices that have stopped reporting. We also send the matching all-clear when the condition resolves. It is not a marketing program and we do not send marketing by SMS.
- Who gets messages. Only the people a customer designates as on-call for one of their buildings, and only for those buildings.
- Message frequency varies. Messages are sent when a monitored condition changes, so volume depends on the building and the season. A quiet building may go weeks without one.
- Message and data rates may apply. Your mobile carrier's standard messaging and data charges apply to messages you receive from us.
- To stop messages, reply STOP. You will receive one confirmation and then no further alerts at that number. Stopping messages stops your alerts: you will not be notified of conditions at the buildings you are on call for. Ask your account holder to remove or replace you as a contact, or reply START to resume.

- Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your handset, and we cannot guarantee that any individual message arrives.
We use the phone numbers enrolled in this program only to send these alerts. We do not sell them and we do not share them with third parties for marketing — see the privacy policy.
Fees
Pricing is as agreed with the customer in writing. Hardware supplied as part of a pilot remains as described in that agreement.
Limitation of liability
To the extent the law allows, Thermofi is not liable for indirect or consequential loss, and our total liability is limited to the fees paid for the service in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
